1. General
1.1

The website store.punjabkingsipl.in ("Platform") is owned by K.P.H. Dream Cricket Pvt. Ltd. ("Company", "we", "us", "our"), incorporated under the laws of India, with its registered office at Unit-C115, 1st Floor, Office Complex, Plot No. 178-178A, Industrial & Business Park, Phase-1, Chandigarh (U.T.) – 160002. The Platform is operated and managed by Shopsense Retail Technologies Limited ("Fynd"), the official technology and operations partner.

1.2

The Platform is a dedicated e-commerce marketplace for official Punjab Kings licensed merchandise, kits, accessories, and related products, where authorised third-party sellers ("Sellers") offer Products to users ("Users", "you", "your", "Buyer").

1.3

These Terms and Conditions ("Terms") constitute a binding agreement between the Company and any person who browses, accesses, or uses the Platform, or creates an Account on the Platform.

1.4

By using the Platform, you agree to be bound by these Terms, the Privacy Policy, Returns & Cancellation Policy, Shipping & Delivery Policy, and any other applicable Platform Policies (collectively, "Platform Policies"). If you do not agree, please do not use the Platform. For queries, contact Shop@Punjabkingsipl.in.

This document is an electronic record under the Information Technology Act, 2000, published in accordance with Rule 3(1) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and does not require any physical or digital signatures.

1.6

These Terms are bifurcated into three Parts: Part A – Terms of Use; Part B – Terms of Sale; Part C – General Legal Provisions.

2. Definitions
2.1
  • Account: Your registered profile on the Platform.
  • Buyer / User / You: Any natural or legal person who accesses the Platform and/or places an order.
  • Seller / Vendor: Any third-party vendor authorised by the Company to list and sell Products on the Platform, onboarded through Fynd's OMS.
  • Fynd: Shopsense Retail Technologies Limited – the official technology and operations partner managing the Platform, payments, logistics, returns, and customer support.
  • OMS: The Order Management System dashboard provided by Fynd to Sellers for inventory and order management.
  • Products: Official Punjab Kings licensed merchandise, kits, and accessories listed by Sellers on the Platform.
  • GTA / GT Charges: Goods Transport Agency and the associated transport charges collected at checkout.
  • Punjab Kings Credits: Promotional balance or wallet credits issued by the Company (if applicable).
  • Platform Policies: Returns & Cancellation, Shipping & Delivery, Payments, Privacy, and other policies incorporated by reference.
3. Platform & Technology Partner
3.1

The Punjab Kings Store is an official e-commerce subdomain of the Punjab Kings main website (punjabkingsipl.in), exclusively for official Punjab Kings licensed merchandise and fan gear.

3.2

Fynd (Shopsense Retail Technologies Limited) is the exclusive technology and operations partner, responsible for: building and hosting the Platform; payment processing and Seller settlements; logistics management through GTA / courier partners; reverse logistics, returns processing, and quality checks; end-to-end customer support; and providing Sellers with OMS dashboard access.

3.3

Sellers are responsible for uploading inventory, maintaining stock readiness, and processing shipments within prescribed timelines. Fynd's operations team monitors order timelines and assigns delivery partners.

Part A – Terms of Use of the Platform

Governs your access to and general use of the Platform.

4. Account Registration
4.1

You must be competent to contract under the Indian Contract Act, 1872. Users under 18 must have a parent or legal guardian register and transact on their behalf.

4.2

Registration is free. You may register using your name, mobile number, and email address, or via third-party login (e.g., Google), subject to that provider's terms.

4.3

You are solely authorised to operate your Account and are responsible for maintaining the confidentiality of your login credentials and all activities under your Account. Notify us immediately at Shop@Punjabkingsipl.in of any unauthorised use.

4.4

Your mobile number is your primary identifier. You are responsible for keeping it current and accurate at all times.

4.5

Dormancy: If you do not access your Account for 2 (two) consecutive years, the Company may delete your Account data, subject to applicable legal retention requirements.

5. User Obligations & Acceptable Use
5.1

You agree to provide true, accurate, and complete information at all times and to keep your Account information updated.

5.2

You shall not: upload unlawful, harmful, defamatory, or obscene content; attempt to gain unauthorised access or deploy bots / scrapers; misuse offers, vouchers, or Credits; engage in bulk or commercial resale where prohibited; upload malicious code; impersonate any person; or publish false or misleading statements about the Platform or Punjab Kings.

5.3

We may cancel orders, restrict features, or suspend Accounts where we detect invalid addresses or repeated delivery refusals, voucher or offer abuse, payment verification failures, excessive return behaviour, or use of glitches or loopholes.

6. Communication & Opt-Out
6.1

By registering, you consent to receive transactional and promotional communications via SMS, email, or other digital means, even if registered under DND/NCPR, in accordance with applicable TRAI regulations.

6.2

You may opt out of marketing communications at any time via the unsubscribe link in emails, Account settings, or by writing to Shop@Punjabkingsipl.in. Transactional communications (order confirmations, shipping updates, return notifications) will continue as they are necessary to your transactions.

7. Platform Role & Online Facilitation
7.1

Unless the Company is expressly the seller of record, the Platform is a facilitator and is not a party to any contract of sale between you and a Seller. All sale contracts are strictly bipartite between Buyer and Seller.

7.2

The Company and Fynd do not hold title, right, or interest over Products sold by Sellers, and assume no liability in respect of such sale agreements. Commercial terms are set by Sellers.

8. Disclaimer of Warranties
8.1

We endeavour to ensure Platform information is accurate but do not guarantee accuracy, completeness, or timeliness of Product descriptions, prices, or availability. Visual representations are illustrative only; delivered Products may vary.

THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "WHERE-IS" BASIS WITHOUT ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY AND FYND WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.
9. Availability & Accessibility
9.1

The Platform is operated from India and is intended solely for users within India. Products are available for delivery within India only. The Platform may be periodically suspended for maintenance without prior notice.

10. Third-Party Links & Service Providers
10.1

The Platform may link to third-party websites (including punjabkingsipl.in). The Company is not responsible for the content, data practices, or privacy policies of any third-party websites.

10.2

Fynd integrates third-party GTA / logistics partners and payment gateways. Your relationship with such providers is governed by their respective terms; the Company assumes no liability for their services.

11. Content & Intellectual Property
11.1

All Platform content — including the Punjab Kings name, logo, branding, imagery, audio, video, design, layout, software, and databases — is the property of K.P.H. Dream Cricket Pvt. Ltd. or its licensors, protected under Indian copyright, trademark, and applicable laws. Use is permitted for personal, non-commercial purposes only.

11.2

By posting User Content (reviews, photos, ratings), you grant the Company a worldwide, royalty-free, non-exclusive, perpetual licence to use, reproduce, adapt, and distribute such content on the Platform and in marketing materials.

12. Suspension & Termination
12.1

The Company may suspend or terminate your Account for breach of these Terms, fraudulent or unlawful conduct, misuse of offers, returns, or Credits, or providing false details. Upon termination, access ceases immediately and any Credits are forfeited. You may close your Account at any time by writing to Shop@Punjabkingsipl.in.

13. Data Protection & Privacy
13.1

Your personal data is governed by the Punjab Kings Store Privacy Policy, which forms an integral part of these Terms. The Company complies with the Digital Personal Data Protection Act, 2023 (DPDP Act) and the Information Technology Act, 2000. You consent to the sharing of necessary data with Sellers, Fynd, GTA / logistics partners, payment gateways, and regulators as described in the Privacy Policy.

Part B – Terms and Conditions of Sale

Governs the purchase of Products between you (Buyer) and the Seller.

14. Sale on Platform
14.1

All commercial and contractual terms — including price, delivery timelines, and product warranties — are offered by and agreed between you (Buyer) and the respective Seller. The Company and Fynd do not control or determine such commercial terms. The contract of sale is a strictly bipartite contract between Buyer and Seller; Seller details are displayed on the product listing page.

15. Listings & Pricing
15.1

Prices are set by Sellers and may differ across Sellers. Prices may change before you place an order. Taxes and GTA / shipping charges are displayed at checkout. In case of a pricing error discovered post-order, the order may be cancelled and fully refunded.

16. Orders & Contract Formation
16.1

Your order is an offer to buy; acceptance occurs upon dispatch by the Seller. Orders may be cancelled due to stockouts, address issues, payment risk, or legal restrictions. For multi-Seller carts, each Seller processes its portion separately; partial shipments may occur. If a Seller rejects an order for objective reasons, any amount charged will be fully refunded.

17. Delivery & Risk
17.1

Delivery timelines are estimates only and are performed by independent GTA / logistics partners managed by Fynd. Delivery Claims Window: Claims of non-receipt or non-delivery must be raised within 2 (two) days of the delivery date on Platform records; after this period, the order is deemed duly delivered. If delivery fails due to your unavailability, incorrect address, or refusal, the order may be cancelled and any refund processed after deduction of applicable logistics charges. If a package appears damaged or tampered at delivery, refuse acceptance and notify the Company / Fynd via the Help Centre immediately.

18. Returns & Refunds
18.1

Return requests may be raised within 2 (two) days of receipt via the Platform or by writing to Shop@Punjabkingsipl.in. Eligible reasons: (a) wrong size or specification; (b) material manufacturing defect; (c) product delivered damaged, unsealed, or tampered ("Defective Product"). A minor variation in colour shade does not constitute a difference in specification.

18.2

For Defective Products, you must notify the Company and Fynd via the Platform within 48 hours of delivery. Failure to notify within this period constitutes unconditional acceptance of the Product.

18.3

Non-returnable Products (unless Defective): masks; innerwear, lingerie, swimwear, and cosmetics; perishables and hygiene-sensitive items; customised and altered products; and any items marked "Non-Returnable" on the product page.

18.4

Returns will not be entertained if the Product has been used beyond checking fit and comfort, washed, has damaged or discarded tags / original packaging, has a mismatched serial number / barcode, or has been rendered defective or unusable by the User.

18.5

On approval, the Company / Fynd / Seller will arrange pickup (or request self-shipment where reverse pickup is unavailable). Products must be returned in original condition with tags, packaging, and original invoice. If two consecutive pickup attempts fail due to reasons attributable to you, you shall be deemed to have accepted the Product as-is and no refund obligation shall arise.

18.6

Subject to the returned Product passing quality inspection, the refund will be credited to your original source account within 7 (seven) business days of completion of the quality check (to be completed within 7–10 business days of warehouse receipt). Alternatively, a coupon of equivalent value for future purchases from the same Seller may be issued within 14 business days. No return, refund, or cancellation is available for BOGO offers except for Defective Products.

19. Payments & Verification
19.1

All payments must be in INR through supported instruments via authorised payment gateways managed by Fynd. Cash on Delivery (COD) is not available on this Platform. All orders must be prepaid.

19.2

For high-value purchases (≥ INR 2,00,000) or as required by law, the Company or Seller may request PAN, government-issued ID, or address proof. Failure to provide may result in order cancellation. Refunds are credited to the original payment source; the Company is not responsible for bank-side delays after refund initiation.

20. Shipping & GT Charges
20.1

Deliveries are facilitated through independent GTAs engaged by the Company, Fynd, and/or Sellers. Applicable GTA charges are displayed at checkout. Transportation is governed by the consignment note issued by the GTA. A Platform Fee for upkeep may also be charged and displayed at checkout. Products are delivered within India only. GTA charges on returned Products are refunded in accordance with the Returns & Cancellation Policy.

21. Fraudulent or Invalid Orders
21.1

The Company may cancel, suspend, or refuse any order it reasonably determines to be fraudulent, bulk, or invalid (including where Products are ordered for commercial resale, multiple orders at the same address in restricted categories, invalid addresses, or misuse of vouchers / Credits). Promotional benefits on such orders may be forfeited without refund.

Part C – General Legal Provisions

Indemnity, liability, governing law, and other legal provisions.

22. Indemnity
22.1

You agree to indemnify, defend, and hold harmless K.P.H. Dream Cricket Pvt. Ltd., Fynd, their respective directors, officers, employees, affiliates, and service providers from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your breach of these Terms or Platform Policies; (b) your violation of any applicable law or third-party rights; (c) your misuse of the Platform; or (d) User Content you submit that infringes any rights or causes harm.

23. Limitation of Liability
23.1

To the maximum extent permitted by law, the Company and Fynd are not liable for indirect, incidental, consequential, special, or punitive damages. The Company's aggregate liability is limited to the value of the Product(s) that are the subject of the specific claim. Neither the Company nor Fynd is responsible for force majeure events, network failures, or defaults by external service providers including GTA / courier partners or payment processors.

24. Compliance with Laws
24.1

You agree to comply with all applicable laws while using the Platform, including the Foreign Exchange Management Act, 1999; Customs Act, 1962; Information Technology Act, 2000; Prevention of Money Laundering Act, 2002; Consumer Protection Act, 2019; Legal Metrology Act, 2009; Income Tax Act, 1961; and applicable GST laws.

25. Governing Law & Jurisdiction
25.1

These Terms are governed by the laws of the Republic of India. The courts of Chandigarh, India shall retain exclusive jurisdiction over all disputes arising out of or in connection with these Terms, the Platform, or any transactions.

27. Miscellaneous
27.1 Entire Agreement

These Terms and Platform Policies constitute the entire agreement between you and the Company for Platform use.

27.2 Amendments

The Company may modify these Terms by posting updated versions on the Platform. Continued use constitutes acceptance of the revised Terms.

27.3 Severability

If any provision is found invalid, the remaining provisions shall continue in full force.

27.4 Force Majeure

Neither the Company nor Fynd is liable for non-performance due to events beyond reasonable control, including natural disasters, strikes, cyberattacks, or governmental actions.

27.5 Survival

Clauses on indemnity, liability, intellectual property, governing law, and dispute resolution survive termination of these Terms.

27.6 Acceptance

By registering, browsing, or purchasing on the Platform, you confirm you have read, understood, and agreed to these Terms and all Platform Policies.
